Sri’s dissertation fights for the efforts to alleviate the family’s grief due to the death from the unlawful acts. The current legislation does not sufficiently provide a clear definition of a loss. It does not explicitly regulate any criteria for both material and immaterial loss. Moreover, there is no valuation method to estimate the value of a dead person in civil cases.
This dissertation research applies the normative legal research method and legal comparison method. Furthermore, this research uses 18 civil cases (comprise 42 court decisions) that are tried in courts in Indonesia as a primary legal resource. This paper suggests a reformulation or revision regarding the definition of loss, the classification of material loss, immaterial loss, and the valuation method that can be used to describe, determine and prove the value of the loss to be compensated especially loss from wrongful death in private law cases.
After presenting her dissertation and answering the questions raised by the board of examiners, Sri Laksmi Handayani was awarded the title of Doctor of Legal Studies with a very satisfying predicate.
