In her dissertation, Genio said that the main issue of whether or not the legal use of the obligation to increase the added value of minerals applied is also inseparable from various other legal problems found in the field. Among them are issues related to legal certainty in regulation and implementation of obligations to increase the value-added of minerals in the country. For this reason, the main problem of this study is whether the obligation to increase the added value of minerals applied has fulfilled its objectives as stated in Article 33 paragraph (3) of the 1945 Constitution?
With this issue in mind, Genio conducts research by analyzing the obligation to increase added value for metal minerals in Indonesia. This research has an objective to conduct a philosophical analysis and regulation of the obligation to increase the added value of metal minerals, as well as the impact of increasing the value-added of metal minerals in their correlation to realize the greatest prosperity of the people. Research conducted is a form of normative juridical research. This study found that the provisions of article 33 paragraph (3) of the 1945 Constitution relating to the use of nature manifest the greatest prosperity of the people is a philosophical foundation of the regulation of the obligation to increase added value.
To answer the question of how the regulation and implementation in realizing the prosperity of the people in Indonesia, this study uses the opinions or writings of legal experts regarding the obligation to increase the added value of metal minerals.
