Professor of Faculty of Law Universitas Indonesia, Prof. Dr. Andri M Gunawan, asked the Job Creatin Bill’s committee and the government do not remove the administrative sanction in the form of freezing or revocation of environmental permits in the Job Creation Bill. According to Andri, the administrative sanction listed in the bill related to environmental management is not yet firm.
“Coagulation or revocation permission had been removed (in the Job Creation Bill), not expressly, maybe in the back article there. However, that does not expressly lead to permits.” Andri said, Wednesday (10/6/2020)
As for in Law Number 32 year 2009 concerning Protection and Management of Environment, there are administrative sanctions in the form of freezing or revocation of environmental permits for businesses that do not carry out government coercion because it violates environmental protection.
The regulation stated in Article 79 read as: “The administrative sanction such as suspension or revoke of environment permit as cited in Article 76 paragraph (2) letters c and d do shall be imposed upon in case that the person in charge of the undertakings and/or activities fails to accomplish the compulsion by Government.”
