Professor of Faculty of Law Universitas Indonesia, Hikmahanto Juwana, criticized the Draft of Mineral and Coal Mining Law (RUU Minerba) prepared by The House of Representatives of The Republic of Indonesia (DPR) and the government.
In his presentation, Hikmahanto emphasized and evaluated the Mineral and Coal Mining Law No. 4 of 2009, in which the government itself had many complaints because there were rules that could not and were difficult to implement.
this needs to be reviewed again what makes a law can not work, whether the formulation of the rules or the lack of law enforcement. If we are not careful in formulating a regulation, he is worried that the same thing will happen in the Draft of Mineral and Coal Mining Law.
The government, he said, in preparing regulations concerning the regulation of natural resources today, needs to change the mindset so that the rules will be effective and beneficial for Indonesia.
“Change the mindset, the regulator needs to change the mindset first. The mindset that carried is too old, of course, the conditions in 1967 are different from the present, the mindset is different and not to be equated continuously,” said Hikmahanto, in a virtual press conference on Wednesday (4/29/2020).
