“Customary Villages in the Indonesia Context: Analysis of Indigenous Village Government Post-Law Number 6 of 2014 concerning Villages”
Laily Fitriani succeeded in defending her dissertation entitled “Customary Villages in the Indonesia Context: Analysis of Indigenous Village Government Post-Law Number 6 of 2014 concerning Villages” before the Academic Session of the Faculty of Law, Universitas Indonesia led by Prof. Dr. Rosa Agustina, S.H., M.H., With members consisting of Promoter Dr. Tri Hayati, S.H., M.H., Co-Promoter Dr. Harsanto Nursadi, S.H., M.Sc., and Dr. Zen Zanibar, S.H., M.H., Examining Board consists of Prof. Dr. Rosa Agustina, S.H., M.H., Prof. Johermansyah Djohan, MA., Prof. Dr. Irfan Ridwan Maksum, M.Sc., and Dr. Ratih Lestarini, S.H., M.H.
The Dissertation Meeting was held on Friday, January 18, 2019 at the Djokosoetono Convention Center, FHUI, Depok, at 13.30 – 15.30 WIB.
In her dissertation, Laily Fitriani examines the terminology of traditional villages where there is a significant potential for indigenous territories, compared to the total number of regions in Indonesia, which is around 840 million hectares. Because, the human dimension and region are a whole unit that is normatively regulated in Article 18B paragraph (2) of the 1945 Constitution that “The State recognizes and respects customary law units and their traditional rights …”
Laily Fitriani conducts research with normative legal research methods whereby critical analysis is carried out qualitatively and is descriptive-analytical. By analyzing the position of indigenous villages and villages in the Government system in Indonesia, the implementation of Indigenous Villages in West Sumatra, Bali and Maluku, and the concept of Customary Villages in the Indonesia context.
The results of this study are the position of traditional villages and villages in the government system in Indonesia period 1948-2014 can be understood based on the substance of form (village and traditional village), legal sources (legislation and customary law), and the government system (self governing community, local self government and local state government).
After presenting her dissertation and answering the questions raised by the board of examiners, Laily Fitriani was awarded the title of Doctor of Legal Studies with a very satisfying predicate.
Dr. Laily Fitriani is the 261th Doctor produced by the Legal Studies Program, the Postgraduate Program of the Faculty of Law, Universitas Indonesia, is the 4th Doctorate (four) who graduated in 2019 and 226th Doctorate (two hundred and twenty six) who graduated after the Postgraduate Program was held directly by the Faculty of Law, Universitas Indonesia.
