Course Description

  • Introduction to Indonesian Islamic Law

This course will provide an introduction to the application of Islamic law in Indonesia. This term refers to legal materials about Islamic Law and its interaction with other Laws in Indonesia, and the application on some areas of Islamic Law in Indonesia’s regulations and Practices. During the first part of this course, will be introduced the main sources of Islamic law, the formation of Islamic jurisprudence, and the legal history of the development of Islamic law and legal institutions in Indonesia which will be examined with other law in Indonesia which existed in the societies. In the second part of the course, we will sample several substantive areas: Islamic Law and Economic Activities, Islamic Criminal Law in Aceh and Islamic Property Law in Practices. These areas will include a study of various cases where Islamic law has been debated in Indonesian courts. The course will also focus on human rights in the Islamic legal tradition and in the contemporary Islamic world, especially in Indonesian regulation.

  • Introduction on Law of Village/District

This course will introduce learners of Indonesian laws and legal system to the phenomenon and existence of “villages” or with other names they are referred to –such as desa in Java, Madura, and Bali; gampong in Aceh; huta in Batak lands; nagari in Minangkabau; and so on– as the autochthonous polity of Indonesians and how they are recognized by the laws and legal systems from time to time. For centuries, these polities have survived multitude invasions and cooptation by local kingdoms and foreign rulers as well. These villages, subsequently, serve as the basic building blocks of Indonesian statehood, and now are the smallest autonomous local government units that directly engage Indonesian people on a daily basis.

  • Introduction to Indonesian Constitutional Law

This course will introduce the constitutional law that applies in Indonesia. It is started with the basic concept of state adopted in the Indonesian legal system covering the form of state and the system of government; the system of the division of powers covering various state institutions’ and the application of checks and balances principles between them; the organizational structure of the state covering central and local government systems; the constitutional court and its powers; as well as the contemporary dynamics of the Indonesian constitutional law.

  • Introduction to Indonesia General Election

This course will discuss the history of general elections in Indonesia, the electoral system in Indonesia, the implementation of general elections in Indonesia, the organizing body of general elections in Indonesia, supervision and law enforcement of general elections in Indonesia, especially election criminal law, as well as contemporary issues regarding elections in Indonesia.
